These Retailer Terms outline the conditions under which merchants (“Retailers”) may use Giftify services to offer gift-related features to their customers. By integrating Giftify, you agree to comply with these Terms.
Eligibility and Account Setup
- You must have a valid Shopify store or other supported e-commerce platform account.
- You agree to provide accurate business and contact information when registering with Giftify.
Use of Giftify Services
- Giftify provides tools for offering gift notes, wrapping, and related services.
- Retailers are responsible for configuring options correctly within their store theme.
- You may not misuse, copy, or resell Giftify features without authorization.
Fees and Payments
- Giftify may charge subscription or usage fees, as outlined in your plan.
- Payments are processed via Shopify Billing or other approved methods.
- All fees are non-refundable except where required by law.
Retailer Responsibilities
- Ensure that gift options are displayed and function correctly in your storefront.
- Comply with all applicable laws, including data protection and consumer protection regulations.
- Provide accurate order fulfillment, including gift wrapping and note requests from customers.
Customer Data
- Retailers are the primary data controllers for customer information collected via Giftify.
- Giftify processes such data only to provide the services, in accordance with our Privacy Policy.
- You are responsible for ensuring that your customers’ data rights are respected.
Intellectual Property
- All Giftify branding, content, and software remain the property of Giftify or its licensors.
- Retailers may use Giftify branding only as permitted under these Terms.
Termination
- We may suspend or terminate service if you breach these Terms or misuse the platform.
- Retailers may cancel their Giftify subscription through the Shopify Admin or other supported platform.
Limitation of Liability
- Giftify is not liable for lost revenue, indirect, or consequential damages arising from use of the service.
- Our liability is limited to the amount you paid for Giftify services during the last billing cycle.
Changes to These Terms
We may update these Retailer Terms at any time. Continued use of Giftify by the Retailer after updates indicates acceptance of the revised Terms.
